2. Service Description

altux.ai provides software tools that allow users to generate visual images from text descriptions ("Prompts") using third-party Artificial Intelligence technologies (including, but not limited to, Google, OpenAI, and Anthropic).

2.1 Nature of AI

The user acknowledges that AI image generation is a probabilistic and experimental process. The Platform does not guarantee that generated images will be perfect, free of defects, or exact to the provided description. Hallucinations, visual artifacts, or unexpected interpretations may occur.

3. Credits System and Payments

The service operates through the purchase of credit packages ("Packs") or monthly subscriptions.

3.1 One-Time Credit Purchases

• Credit usage: Credits are an internal virtual currency for using the generation tools. The credit cost per image may vary depending on the resolution, quality, or selected model. The Platform will indicate the estimated cost before each generation.
• Prices: Prices are displayed in US dollars (USD) or euros (EUR) as applicable. We reserve the right to modify Pack prices at any time.
• Taxes: In accordance with current regulations, Value Added Tax (VAT) corresponding to the user's country of residence will be applied at the time of payment.
• Purchased credits never expire: One-time purchased credits remain in your account indefinitely and never expire.
• Non-Refundable: Due to the high computational and API costs incurred instantly when generating an image, consumed credits are non-refundable, even if the result is not to the user's liking.

3.2 Subscription Plans

• Monthly billing: Subscriptions are billed monthly on your anniversary date (the date you originally subscribed).
• Credit allocation: Subscription credits are granted at the start of each billing period according to your plan level.
• Credit expiration: Subscription credits expire at the end of each billing period and DO NOT roll over to the next month. Unused subscription credits are lost when the new billing period begins.
• Consumption order: Subscription credits are consumed first. Once depleted, any one-time purchased credits will be used.
• Cancellation: You may cancel your subscription at any time through the Stripe Customer Portal. Upon cancellation, you will retain access until the end of your current billing period.
• Plan changes: You may upgrade or downgrade your subscription plan through the Stripe Customer Portal. Changes take effect at the start of your next billing period.
• Combining credits: Subscribers may also purchase additional one-time credit packs. These purchased credits never expire and are used after subscription credits are depleted.

4. Refund and Withdrawal Policy

As a digital content service that is not provided on a physical medium, and whose execution begins with the user's prior express consent:

• Exception to the Right of Withdrawal: In accordance with Article 103, section m) of the General Law for the Defense of Consumers and Users (Spain), the user loses their right of withdrawal once they have started using the purchased credits.
• If you have purchased a Pack and have not used any credits, you may request a refund within 14 calendar days of purchase by writing to support@altux.ai.

5. Intellectual Property

5.1 Ownership of Images (Output)

Subject to compliance with these terms, the User retains ownership of the images they generate on the Platform.

• You own the commercial rights to the generated images.
• You may use them for personal or commercial purposes (advertising, web, print, etc.).

5.2 License to the Platform

By generating content, you grant altux.ai a worldwide, non-exclusive, royalty-free license to host, store, and display such images for the sole purpose of providing you the service and maintaining your history in your private gallery.

5.3 Rights Infringement

You warrant that you have the necessary rights to any image or text ("Input") that you upload or enter on the platform for processing. You must not use the Platform to generate content that infringes copyrights, trademarks, or image rights of third parties.

6. Usage Restrictions

It is strictly prohibited to use the Platform to generate:

• Non-consensual or illegal sexually explicit content (NSFW) (CSAM).
• Images that promote violence, hatred, harassment, or discrimination.
• False or misleading information designed to manipulate public opinion (Fake News/Political Deepfakes).

We reserve the right to suspend the account of any user who violates these rules or attempts to bypass the AI's security filters ("Jailbreaking").

7. Limitation of Liability

altux.ai is provided "AS IS".

To the maximum extent permitted by applicable law:

• We do not guarantee uninterrupted service availability (we may depend on Google API outages or maintenance).
• We are not liable for direct, indirect, or consequential damages arising from the use of generated images.
• The user is solely responsible for how they use the generated images and for ensuring that their use complies with the laws of their jurisdiction.

8. Third-Party Providers

We use third-party services for the operation of the App:

• Payment processing: Stripe, Inc. We do not store your complete banking data.
• AI Engines: Google, OpenAI, Anthropic and other providers. Their use may be subject to the acceptable use policies of said providers.

9. Applicable Law and Jurisdiction

These terms are governed by Spanish law.

For any dispute that may arise from access to or use of the Platform, both parties agree to submit to the Courts and Tribunals of the city of Las Rozas de Madrid, waiving any other jurisdiction that may correspond to them, unless the law imperatively establishes otherwise for consumers.
